It's time for Justice Matters with former federal prosecutor and MS NBC analyst Glenn Kirchner. The judge who's presiding over the second E. Jean Carroll case gave some

specific instructions to the jury about Donald Trump.

So friends, as you know, the second E.

Carol defamation trial against Donald Trump is well underway. You'll recall Miss Carroll won the first

defamation case against him to the tune of five million dollars and I suspect

she will win the second case in the jury award this time, will be well north of $5 million.

But the presiding judge, Judge Lewis Kaplan, Federal Court Judge, said something to the jury during jury selection, gave a very pointed instruction to the jury, and what he said provides some important facts, some important context, and I suggest some important

messaging that we should all pick up on and we should repeat early and often particularly

as the November 2024 presidential election approaches.

So let me first briefly talk about jury selection and then let's turn to what Judge Kaplan instructed

the jurors in the second E. Jean Carroll defamation case against Donald Trump.

So first of all, friends, I have long maintained that you can't win a case in jury selection,

but you can sure lose it. It is such a vitally important part of the

jury process being able to impanel a fair and impartial jury. A jury that can swear under oath because when you're going through jury selection

what we call voir dire the jurors are placed under oath and they're required to

answer questions posed to them

by the judge, by the parties, the prosecutors

or the plaintiff's attorney and the defendant's attorney

or the respondent's attorney.

They're required to answer those questions truthfully. So everybody

can gauge whether they can sit fairly and impartially in the case. They can set aside
