Hello everyone and welcome to police off the cuff for real crime stories. I'm your host,

retired NYPD sergeant. Bill Cannon, a 27-year veteran of the NYPD. So much is going on

in the Idaho War case.

And people have been sort of freaking out online asking that very question,

is the Idaho case in jeopardy?

Because of these leaks to Dateline NBC, has that hurt this case? Will Judge Hippler throw out evidence based on these

leaks? It would seem to me a little bit ridiculous to punish the prosecution from something they had no

control over. And I would imagine every district attorney reads the Riot Act to all his people

day one on how important secrecy is and not divulging any of the evidence that they have

to anyone, and especially the press.

But I don't know, and that's why I have Professor Mike Gehry on tonight,

I don't know if this is going to affect the case so much that he would consider throwing out evidence. I don't know. But this has damaged the case.

And it has brought a negative spin on this. Because in this country, we care whether someone is

apparently guilty or innocent.

We want them to get a fair trial.

And that's what we believe in this country.

And again, Brian Koberger is presumed innocent to proven guilty.

So all of those things we're going to discuss tonight.
