Summary

What does the U.S. capture and prosecution of Venezuela’s Nicolas Maduro reveal about presidential power, immunity, and the limits of the law? In an excerpt from this week’s Insider episode, Preet Bharara and Joyce Vance discuss many legal issues raised by Maduro’s apprehension and indictment: Is this really a drug-trafficking case, a foreign policy move disguised as a law enforcement action, or both? And why is the case being handled by Preet’s former office, the U.S. Attorney’s Office for the Southern District of New York? In the full episode, Preet and Joyce dive deeper into the military action in Venezuela and the Maduro prosecution. Can Maduro successfully claim immunity as a head of state? How does that compare to the immunity the U.S. Supreme Court has given U.S. presidents? And what role has  Congress played in limiting or enabling overseas uses of force? So should we talk about the charges or the arrest? Well, let's start with the charges,

0:50.5

just so we know what we're looking at. So it's a speaking indictment, as they say,

0:54.6

that at first blush seems to have a lot of detail. It talks about the conveyance of massive,

1:01.1

massive amounts of drugs, cocaine into the United States. By the way, you know,

1:05.9

almost the only people who get talked about are Maduro and his wife, because that's interesting to folks.

1:12.6

But there are, you know, as I said, six defendants, and there have to be allegations with

1:16.6

respect to all of them for an indictment to be satisfactory. So there are a lot of things about

1:20.3

them. I don't know that there's a lot in the indictment that has been unsealed and that's publicly

1:24.8

available and that we can all talk about and vet

1:28.7

and analyze and evaluate that there's a lot new in terms of what kind of evidence they have

1:33.5

against Maduro. That is not required in an indictment. So when we get the question, which I guess

1:39.7

we should ask ourselves, from the reading of the indictment, how strong do you think the case is?

1:50.1

That's a little bit hard to answer. But I'm guessing, unlike, is often the case in recent weeks and months on this show, that the case is probably pretty strong. Yeah, I mean, let me just put an
