Please be seated. Okay, good morning. We are on the record on KCR 22, 21, 1624 State of Idaho versus

Lori, Noreen Valo.

The matter is continuing through trial.

State continues with its case in chief.

The court would note the prosecution's here present

as well as the defendant and the defense.

The court had a conference with counsel this morning in regards to a legal issue that's arisen in the case

with the current witness that's being questioned and that's Mr. Pulowski on

cross-examination, the defense has indicated it wishes to have admitted

and published certain recordings that were made by the witness and the court is considering whether or not those should be

admitted in the case or be allowed to be published to the jurors.

The courts determine that it's a legal issue that would be best determined outside of the presence of the jury,

since there needs to be a proffer to the court about what the contents of the exhibit may demonstrate and it would be improper for the

jurors to hear that in the event that the court determines the evidence is not

admissible. So at this point I'd like to hear argument on the record as to what is

intended to be introduced here in these recordings if the defense could lay a record of that including any proffer of what you would say the

recordings would show and how those would be relevant and admissible and then if

there's any objection I'll hear that from the statement so Mr Archibald. Your Honor, first of all, I point out to the court that I did ask for Ian Pulowski to be dismissed

yesterday that he not be allowed to testify at all.
