I love the First Amendment. I have defended the First Amendment and that's why I'm suing

CNN for it defaming me by putting in my mouth the opposite of what I actually said. You'll hear the story. I'm

Alan Dershowitz. This is the Dersh show. I love the First Amendment. I've

litigated cases all the way up to the United States Supreme Court on the First Amendment.

I represented the play Hair, Member Hair, the Age of Aquarius.

I won that case on First Amendment grounds. In light of my love and support

for the First Amendment, you may wonder, why am I suing CNN? The CNN people are going to claim they had a First Amendment right and I'm going to say no they didn't.

So a little background on why I'm suing them you may remember that I was asked to make the case against

the impeachment and removal of President Trump.

So I went on the floor of the Senate

and for an hour and seven minutes,

I made a distinction between criminal conduct and non-criminal conduct. I argued that the phrases in the Constitution,

treason, bribery, or other high crimes and misdemeanors requires that for an act to be an impeachable one,

it has to be criminal-like behavior, criminal, criminal, criminal, criminal.

That's what I talked about for an hour and seven minutes. Criminal behavior, if it's criminal like behavior you can

impeach. If it's not criminal behavior like abuse of power or obstruction of

Congress, no you can impeach.

That was my point.

I then went back to the Senate to answer questions.

And two senators, Senator Ted Cruz, and another,

asked the question whether or not a quid pro quo

is by itself an impeachable offense.
