Nicole Wallace for most of us this stretch between Christmas and the new year is a sleepy, slow, lazy

period of time but not if you're Jacksmith. You might have thought the Special Council

would take a breather this holiday, especially since Judge Tanya Chutkin

has pressed pause on the federal election interference case against Donald Trump

till the question of presidential immunity is resolved. But no,

Jack Smith has been working away. Case in point, this morning, the Special

Council unleashed a scathing new filing, putting the disgrace twice impeached, four times indicted

ex-president on notice about his rhetoric and

disinformation. Kind of rhetoric and disinformation we have heard over and over and

over again. Whether it's when Trump is bloviating about witch hunts and election

interference outside a civil fraud trial in New York, or in late night Christmas

rage posts on truth social. Now Donald Trump can say what he wants online outside of court, but what he cannot do,

Jacksmith argues, is make those dubious claims before a jury during his upcoming federal

election interference trial.

Quote, through public statements, filings, and argument in hearings before the court,

the defense has attempted to inject into this case partisan political attacks and irrelevant and prejudicial issues that have no place in a jury trial.

Although the court can recognize these efforts for what they are and disregard them, the jury, if subjected to them, may not.

The court should not permit the defendant to turn the courtroom into a forum in which

Trump propagates irrelevant disinformation and should reject his attempt to inject

politics into this proceeding. Jack Smith then ticks off a highlight reel
