Hey there, it's Kristen, and today I'm bringing you a significant update in the case of five-year-old Harmony Montgomery.

This is a case that has been extensively covered on the show with a two-part episode back in 2024.

The nutshell of this case is that five-year-old Harmony Montgomery had been missing for two years before she was reported missing in 2021.

Her father, Adam Montgomery, was later charged

with her murder and he was convicted in 2024. But now, nearly two years after a jury convicted

Adam Montgomery of second-degree murder, the New Hampshire Supreme Court has overturned that

conviction. Yes, you heard that right. They overturned Adam's murder conviction.

On Thursday, June 11, 26, the New Hampshire Supreme Court ruled that Adam Montgomery did not

receive a fair trial on the murder charge. At the center of the decision was evidence related to

a separate assault charge. So basically, during Adam's murder trial,

there were also other charges that the jury was considering too. Prosecutors alleged that

months before Harmony's death, Adam struck her in the face and gave her a black eye. Jurors heard

testimony about that incident, as well as evidence, suggesting that Adam had physically abused

Harmony on multiple occasions. The Supreme Court concluded that the assault evidence was highly

emotional and inflammatory, and that trying the assault and murder charges together created an

unacceptable risk that jurors would use evidence of Adam's past conduct to conclude he had

a propensity for violence, and therefore

must have committed the murder. The court found that this evidence likely influenced the jury's

consideration of the murder charge, particularly because there was no direct physical evidence

linking Adam to Harmony's death, and prosecutors relied heavily on circumstantial evidence

and Kayla's witness testimony.
