Miss Gussie Human, 19 of 926 Hatch Avenue, and Joseph Labashi, 20 of 72 Troutman Street,

were held today in the Jamaica Police Court on a charge of homicide following the death

yesterday of Harry Garby, a recently discharged soldier of 1416 Chester Avenue, Woodhaven.

The prisoners were denied bail until the examination, November 15.

Garby was shot in the left lung and abdomen last October 27th, while walking, it is alleged by the police,

along Woodhaven Boulevard with Miss Human. According to the story pieced together from

statements of the wounded boy, two men jumped out of the darkness and without speaking,

fired two shots at him, both taking effect.

It is charged the girl then fled with the men.

Within five hours of the shooting, La Bashi and the girl were arrested.

They had just returned from the dance in Brooklyn.

Both denied all knowledge of the attack,

and the girl denied that she had been with

Garby that evening when he fell to the road mortally stricken. The police placed great importance on the

testimony of John Kinsella, 20, who lives at the aqueduct. Kinsella picked up Garby and helped

him to a motor bus, which carried the

wounded man to a farmhouse, from which the ambulance of the Mary Immaculate Hospital removed him.

According to the police, Garby told Cancella that if he died, quote, tell them that Gussie framed me, unquote.

The police ascribe to jealousy the motive for the shooting. Garby was the son of Anthony Garby,

former deputy sheriff of Queens County. Besides his father, he is survived by his mother, two brothers and a sister.
