The Supreme Court takes up a case on the Seventh Amendment, which could be a big ruling for the future of the

administrative state. Welcome I'm Kyle Peterson with the Wall Street Journal.

We are joined today by my colleagues, columnist Alicia Finley and Kim Strassal.

On Wednesday, the justices will hold oral argument in a big case on the seventh amendment.

No, not the second amendment.

That's the well-known right to bear arms.

We're looking five amendments down, lucky number seven.

And here it is in suits at common law where the value and controversy shall exceed $20.

The right of trial by jury shall be preserved, and no fact tried by a jury shall be otherwise re-examined in any court of the United States

than according to the rules of common law. And this is at issue in a case called the SEC versus George Jarkassee that involves an administrative law judge ruling that Mr. Jarkassee had to pay a penalty of $300,000 under the Securities and Exchange Commission's rules.
