Former President Trump faces his second impeachment trial this week as the Senate weighs in to determine his guilt or innocence now as a private citizen.

For incitement of insurrection, that is the one charge against the former president. And that, of course, pertains to the riot on Capitol Hill that turned deadly on January the 6th. So I got to

sit down this week with former independent counsel, Ken Starr, an expert on this subject who made

his name heading up the investigation that led to former President

Bill Clinton's impeachment and surrounding all of that. He also served on former president

Trump's first impeachment defense team just last year. Judge Ken Starr joins me now for our

podcast with his untold story. Ken, great to have you here today. Thanks so much for doing this.

Oh, thank you, Martha. Thank you for all that you're doing. You're just doing a great job, and I know this has been a

demanding week. Oh, thank you. There's a lot to cover. And, you know, you get to the point where

impeachment has just sort of become this thing that becomes part of our fabric of our life, I guess.

It's the second time we've been through it in just over a year for President Trump. Do you think that this effort is legally merited

against the former president? I think it's part of a national tragedy and no. I wish that

Senator Tim Kane of Virginia would have been successful in his effort to find some

middle ground. He was talking apparently with his Democratic colleagues about censorship,

or censure, I guess not censor. And no, the impeachment is unconstitutional. And I realize many people, many thoughtful people are of a different view.

But here's my view.

This is simply not authorized by the Constitution.
