There are right ways and wrong ways to attack the federal power grab that is the new health care law.

Michael Tanner, senior fellow at the Cato Institute and author of the report Bad Medicine,

offers his thoughts on how the GOP and state governments should go about dismantling Obamacare.

Well, the unfortunate fact is that even though Republicans campaigned on the idea that they were going to repeal and replace the health care law.

They're not going to repeal it, at least in the next two years.

I mean, there will be a repeal vote in the House and it will

pass overwhelmingly probably in early January. It would be one of the first things

they do and then it will go to the Senate where it's not likely to even get a vote.

Harry Reed's probably not going to bring it up, so it'll simply die. And if by some reason

it got through you always have a presidential veto so it's not a realistic option

that doesn't mean that there's not a number of things short of repeal that

Republicans can't do to wage guerrilla warfare on this and sort of grind it to a halt if you will.

Now you're talking about at the federal level Republicans on Capitol Hill.

That's right I'm talking about. I'm talking about Congress.

I mean, at the very low end of the scale, you can expect to Congress, especially in the House

where Committee Chairman now have subpoena power and Committee Chairmanhips, that they can demand testimony on behalf of

people like Kathleen Sebelius, who will be up there, I'm sure, every other week explaining

the latest bad news about Obamacare.

Or Donald Berwick, the new director of the Medicare and Medicaid programs, he was put in by a recess

appointment that expires in January. If the president wants him confirmed he's going to now

have to go through hearings on Capitol Hill and you can respect Republicans to
