Summary

A little over a week ago I got an email from Max Jackson’s father asking if we wanted to conduct the only interview with his son Max.  For those who don’t remember who Max is we discussed his situation in great detail on RAWtalk Episode #073.

 

The quick of it is he took photos of a Color Run event that the Color Run ended up asking for permission to use.  They came to an agreement via a Facebook conversation where Color Run could use the images online in exchange for linking back to Max’s Facebook page.  Fast forward a few months and Max’s photos started showing up in advertisements which was not part of the agreed upon usage rights.

 

A lot went down after that including Max being sued by the Color Run and the short of it is that the case has settled out of court.  

 

So here we are with the first and only interview with Max since the entire thing started.  I want to preface the interview by saying I had to choose my questions very carefully.  I really could not dive to deep into the issues that put Max and the Color Run into the situation they ended up since they have a non disparage agreement. 

 

 

With that said I think there are some really solid take home points in this interview.  We now know more about Max and his future endeavors than before.

giving. Now, anything that I say after this is pretty much my opinion or it is my opinion. So

Max has said. This is my opinion on whatever the matter is. And for those of you who aren't

familiar with who Max Jackson is, there was a whole thing with the color run and Max Jackson,

where he allowed them to use photos in a certain area and they overstepped and used them in

different places. Now, again, that's how I perceived it area and they overstepped and used them in different places.

Now, again, that's how I perceived it is that they overstepped and ended up pretty much suing

each other in court. Now, I can tell you now that they have amended the agreement. They've come

to a mutually beneficial, I guess, agreement on their own outside of the court system. So I believe

that it's all resolved. So you're going to have this interview with Max coming up after this,

but you have to know that I couldn't really dive too deep or at all into much about the color

run because you're not allowed to disparage once you have this agreement. They have one of those agreements that says you can't say things that are disparaging towards another company. Now, that's just how these things are. And I didn't want him getting in trouble. And obviously, he doesn't want to get in trouble. So we tried to keep it a certain tone, a certain direction. And I think there's a lot to learn in there. Let me just check my notes here again.
