We have some breaking news as we go live today moments ago in the Daniel Penny trial.

Prosecutors moved to dismiss top manslaughter charge against Daniel Penny after second notice of jury deadlock.

So the highest charge they were pushing for 15 years has been dismissed.

Now they're going to be looking at other charges, but that charge has been dismissed.

They need to dismiss all the charges, but this is a good step in the right direction.

And it really just goes to show you, I would say, what's happening behind the scenes here with this jury.

There are at least people in the jury that see Daniel Penny was not the bad guy.

Daniel Penny does not belong in jail.

But then there were others that looked at Penny, maybe for his skin color, and said,

no, we want him in jail.

But a deadlocked jury forces the highest manslaughter charge to be dropped.

If there are any other updates before the end of today, we will let you know.

But that will be a bit of a sigh of relief, though he is still likely to face other charges

that they haven't dropped yet.

This case should be dismissed.

In fact, it already was dismissed before corrupt Alvin Bragg got involved.
