Welcome everybody to Crystal Kyle and friends as we are recording this today. South Africa

has just presented their case at the

ICJ there of course alleging that Israel is in the process of committing genocide

they're asking for an immediate injunction and so to analyze the strength of

their argument and anticipate what some of the counter arguments may be coming from the Israeli side.

We are honored to be joined by scholar, author, activist, Dr. Norman Finkelstein, author of many books, including one that is very relevant to this moment,

Gaza an inquest into its martyrdom and it's always an honor to see you, sir.

Well, thank you for having me and it's a pleasure to have you.

I did the program last night with Muane Robani,

a kind of preliminary to the hearings.

And I did quote you because I thought you made a very smart remark.

You noted the fact that the South Africa submission was heavily dependent on UN documents, UN officials, UN statements, and that increases the weight of its submission because for the International Court of Justice to dismiss the South African

complaint is in effect to dismiss the entire UN and the ICJ, the International Court of Justice, is the official

legal arm of the United Nations. So by quoting UN documents so extensively, they put the

ICJ in the very uncomfortable position of saying the organization of which they're the legal

arm, that organization lacks credibility.

Right.

And that point you made, which hadn't occurred to me, that by leaning so heavily on UN documents

and UN statements.

It kind of cornered the court.

Either it affirms those documents

and makes a plausible finding of genocide or it denies them but then in effect
