fume, and we examine the historic opinion in every detail. I'm Ben Shapiro. This is The Ben Shapiro Show.

Today's show is sponsored by ExpressVPN. Thousands of my listeners have already secured their

network data to join them. ExpressVPN.com slash men. So to historic decision from the United States Supreme Court, they've now struck down affirmative action in college admissions. There's a violation of the 14th Amendment, the Equal Protection Clause, which suggests that all human beings, regardless of their race, have to be treated equally under the law. And there are a bunch of reasons why they struck it down. I'm going to go through the opinion in full detail. Let's start with this. Affirmative action is deeply unfair on every level. Doesn't matter what race you are talking about. If one race is able to get into college with scores that are 200 points below another race, that is obviously racist and it's obviously discrimination under the Equal Protection Clause, And that's exactly what was happening when it came to Harvard University as well as the University

0:57.5

of North Carolina. Both of those particular colleges were the ones who were named in this lawsuit.

1:03.1

The statistics that are cited in the actual Supreme Court opinion showing Harvard's attempts to

1:09.2

boost minority enrollment demonstrate the disparity between

1:12.1

performances for the groups that got in and the groups that did not get in.

1:16.2

According to the Supreme Court, here were the top academic decile chances of getting

1:21.8

into college.

1:22.4

So you're the top performing people in your particular group, top 10%.

1:26.4

So if you are a top 10% performing Asian,

1:29.8

you had a 12.7% chance in terms of getting into Harvard. If you are a top performing white

1:36.2

student, top decaille, right, meaning the top 10%, this means you had a 15.3% chance of being admitted

1:41.8

to Harvard. If you were Hispanic, you had a 31.3% chance of being admitted to Harvard. If you were Hispanic, you had a 31.3% chance

1:45.4

of being admitted to Harvard. And if you were black, you had a 56% chance of being admitted

1:49.6

to Harvard. These are people with the same scores. What's even more astonishing is that when

1:55.0

you actually look at this chart, you will find that if you are in the fourth academic decadile,

2:00.3

meaning that you perform better than 40% of people, you perform better than 40% of other students when it comes to the, when it comes to test scores in GPA, if you are white, you have less than a 2% chance of getting in. If you're Asian, you have less than 1% chance of getting in. If you're Hispanic, you have a 5% chance of getting in. if you are black, you have a 12.8% chance of getting in. This means you have a better shot

2:21.2

of getting into Harvard. If you're a black student who perform better than 40% of the population,

2:25.9

then if you're an Asian student who perform better than 90% of the population.

2:31.0

That's insane. And that disparity is obviously racist.
