As I'm sure you all know by now, President Trump took to true social over the weekend to announce that he had leaked information that he would be arrested on Tuesday tomorrow as part of a witch hunt investigation by the Manhattan District Attorney's Office.

It was widely reported that New York City District Attorney Alvin Bragg, a radical leftist Democrat, had requested a meeting with law enforcement

to discuss how to handle the logistics of a potential indictment and arrest of a former president.

Now, obviously this is absolutely unprecedented in the history, the entire history of our Republic. We've never come this close to actually arresting a former president.

If you don't know what's going on, Alvin Bragg, the New York DA, is actually trying to make up laws in order to prosecute President Trump. That's how Alan Dershowitz is putting it.

What Bragg is doing, as I understand it, is he's trying to elevate a mere misdemeanor into a felony by turning the alleged hush money that Trump paid Stormy Daniels into a violation of federal campaign finance law.

Now, the problem with that is twofold. First and foremost, campaign finance violation is a matter of federal law, not state law. That's something that would have to be prosecuted by the feds.

But that leads to the second problem, and that's the inconvenient fact that this was rejected by the feds long ago.

The Justice Department reviewed Trump's alleged hush money payout, and concluded that it was a big nothingburger.

My namesake Jonathan Turley explains that the key here was whether the Justice Department could prove that the alleged hush money was paid specifically to cover it up for election purposes.

That's the only way it could be considered violation of federal campaign finance law. But covering up an embarrassing affair could be motivated by a whole host of things.

There's nothing specific to someone's campaign. So the Justice Department recognized it would be impossible to prove this case, and they weren't alone.

The Federal Election Commission chair also rejected the case. So what this New York DA is doing here is he's actually trying to prosecute a federal law that the feds in charge of such prosecution have unilaterally rejected.

The best bride can do is the New York State prosecutors try Trump uniligently falsifying his business records to cover up the alleged hush money, but that's just a misdemeanor in New York.

It's just a slap on the wrist. So Bragg is trying to twist it so that Trump's allegedly falsifying his business records was actually an attempt to cover up violating campaign finance law.

So Dershowitz is saying that a state DA can't do that. You can't combine federal and state statutes, especially when federal prosecutors previously reviewed the case and said there was nothing there.
