Summary

We're introducing a new regular segment of the DCL Duo Podcast - Point-Counterpoint. Sam and I are both lawyers, and so we thought we'd bring a little bit of our argumentative nature into the podcast. Twice each month, we'll "argue" both sides of a topic as suggested by our Patreons, who will also get early access to this show via our exclusive Patreon feed. They'll then vote on the winner, and on the next episode - we'll let you know what they decide! For this innaugural episode we're tackling whether Disney Cruise Line did the right thing in denying boarding to families set to sail on the Dream, who did not have pre-cruise tests for their kids under 12. Spoiler, we do agree with what Disney did here, but had some feedback on the Inspire site and some confusion it created. So, this one shouldn't be too controversial. point counterpoint as you may know if you've listened to the podcast for a while, Sam and I are both lawyers. And so trained in argumentation and the arguments in our household tend to be pretty epic. And so we thought we would bring a little bit of the flavor of home into the podcast. We're also soliciting ideas for point, counterpoint from our patrons and will likely ask our

0:58.7

patrons to vote on who won the argument.

1:01.8

So the next episode, you'll hear who won the argument based on our Patreon feedback.

1:06.2

And yeah, we'll go from there.

1:07.4

But our first topic comes from one of our patrons, and it's a tough one.

1:11.1

They have asked us to argue both sides of Disney denying boarding to families on the first cruise back on the dream.

1:17.1

So to set this up, we know from a prior episode, a bonus show that we released that Disney denied boarding to approximately 20 families aboard the dream off the first cruise.

1:25.1

And we know from later crews, almost 100 families were denied boarding.

1:28.1

I think the last cruise before the one were on currently, we're recording this on the pool deck of

1:32.3

the dream, actually.

1:33.1

And many of those families on the first cruise were denied boarding because they did not have

1:38.1

appropriate testing for their kids.

1:40.0

And so the protocol right now to get on the dream is that you have to have COVID tests within five days of your sailing, a PCR test for anyone who is not vaccinated or does not choose to show proof of vaccination. And then you get a rapid test of the port before you board. And both those tests have to be clear in order for you to set sail. and so there were several families who showed up with little ones the you know the the parents were

2:00.2

vaccinated the little ones were not and they thought the rapid test alone would be sufficient to allow

2:03.7

them to get on board. Did not have the PCR test. So Disney denied them boarding. And so one of our patrons asked us to argue both sides of this equation. Sam and I are struggling with that a little bit. But Sam, as we were talking about, it did have at least sort of one argument in favor of the families.

2:18.5

I'm just going to start by saying and Sam to some extent or I sound to say and Sam are pretty

2:24.1

much in agreement with what Disney did here.

2:26.5

And actually the Patreon who gave us this question is also an agreement with what Disney did

2:30.2

here, but just wanted to know if there was an argument on the other side of the equation.

2:33.0

But essentially, we felt like Disney really over communicatedcommunicated the requirements to those in advance of sailing. And in fact, even after these 20 families were denied boarding, they started giving even notice of the requirements. So we got multiple instances of notice of the requirements that someone on our sailing needed to be tested, that we need to get the testing done.
