I want to update on the final hearing and Donna Adelson's trial.

Skipping a music fact because I just want to get this done today.

The judge comes in after the recess and says he's almost scared to speak and asked if anyone has any issues to raise.

Dan Rashbaum gets up and says he's asked for Charlie's waiver again

and with the change of circumstances Charlie has decided not to give it.

Rashbaum said he did have a waiver in the past December 12th, the 13th, and an independent attorney

spoke to Charlie but did not get a signature on the waiver.

He said we had a waiver.

We thought we had a waiver.

Didn't think there was an issue.

But given the events of the last two days, he approached

appellate counsel to get that new waiver. He thought it was the right thing and

the cleanest thing to do and says he's not able to obtain that at this point and because of that he

needs to withdraw from Donna's case. When asked if the state had anything to say, prosecutor

coupleman said she didn't have anything appropriate to say on the matter,

the judge says that's well put.

The judge asked defense attorney Morris if he wishes to proceed without Dan Rashbaum,
