Summary
Legal legend Alan Dershowitz says a Special Counsel is legal targeting but Trump’s Executive Privilege and Attorney Client Privilege were violated as a result. To what extent has targeting been permissible and the results of targeting justifiable to bring a prosecution. That’s the moral issue of the case. You have to ask whether any American could survive the kind of scrutiny that Trump has undergone if the government went after them? It raises very troubling problems about the American justice system.
Liberals now want to preserve and strengthen the FBI, expand the Espionage Act and Conservatives have become the civil libertarians. Liberals don’t care about the Constitution, it’s get Trump, get Trump. Dershowitz says Trump’s arraignment, trial and appeal should be televised. The public has a right to see how their criminal justice system operates, particularly in a political case like this. It shouldn’t be filtered through MSNBC, CNN or the New York Times where they’ll get a distorted view.
GUEST: ALAN DERSHOWITZ, LEGAL LEGEND AND AUTHOR OF “GET TRUMP”

| 2:52.6 | Thanks for taking the time. I know you're busy as always. So let's go to the case itself. Your assessment of the indictment. |
| 2:59.8 | Well, it's much stronger, for example, than the indictment that came down in the New York case with DA Bragg, which was about the weakest indictment I've ever seen. That was a clear example of somebody being targeted and then after being targeted coming up with a very, very weak indictment. |
| 3:17.8 | This is very different. Here you have a special counsel appointed and the special counsel is appointed only to go and get the this particular person. |
| 3:30.7 | So it's targeting, but it's a different kind of targeting. It's a targeting that's more waffle. And then, you know, he does the investigation and as a result of it, Trump does some unfortunately foolish things with his lawyers and makes a recorded. |
| 3:47.8 | Interview about some classified material and he comes up with them some some indictable offenses and so the question is if the process by which the evidence came out was deeply questionable process is the result justifiable to go forward and I'll give you an exam analogy that may be far fetched, but it's a useful analogy. |
| 4:13.2 | Let's assume in the South in the 1930s a racist Ku Klux Klan prosecutor pledges that you will go and investigate only crimes committed by black people but not by white people when he does the investigation and he comes up with a crime committed by black person. |
