Prosecutors in New York City are asking the Supreme Court to reinstate Pedro Hernandez's

murder conviction in the 1979 disappearance of six-year-old Aiton Pates. They're planning to retry

Hernandez but hope the High Court will short-circuit the process by reinstating his 2017 conviction,

arguing the verdict came after a five-month-long trial with 66 witnesses, some of whom have

since died. Over the summer, a federal appeals

court overturned the verdict, faulting how a New York trial judge answered a question from jurors.

Pates vanished while walking to his downtown Manhattan school bus stop in May of 1979. Hernandez

worked at a nearby convenience store at the time, but didn't become a suspect until 2012. He admitted

to the crime under police

questioning, but his lawyers say he confessed falsely because of a mental illness that sometimes

makes him hallucinate. Hernandez has already been tried twice, a jury deadlocked in 2015,
