I'm Anna Eliopoulos with your Fox True Crime Minute. A conviction overturned for one of the

first missing children featured on milk cartons,

a federal appeals court tossing the guilty verdict of Pedro Hernandez in the killing of six-year-old

Aton Pates. Back in May 1979, the first grader was allowed to walk to the school bus stop by himself,

just a block away, and was never seen again. His case was cold until 2012 when a tip suggested

that Hernandez made remarks years earlier about having killed a child in New York City. Hernandez was a

teenager at the time working at a nearby convenience shop. Despite providing a confession,

defense attorneys always argued that Hernandez is mentally ill, has a low IQ, and confuses reality with imagination.

The appeals court ruling that the trial judge gave incorrect guidance to the jury, and they

are ordering either a retrial within a reasonable period or Hernandez to be released.
