It's still Tuesday, January 7th. We are moving on with keeping up with the Adelson's. We have a new filing that just came out where Charlie is asking to be resentenced.

And we're going to read that in just a moment. But to update, back in October last year, we know Charlie Adelson's attorney asked for his

case to be sent back from the appeals court to the lower court to raise that conflict of

interest issue, which is what ended Donna's trial the day it was set to begin.

And just a reminder, Charlie refused to sign that waiver,

saying it's okay for his former attorney, Dan Rashbaum, to also represent Donna at her trial.

And Charlie wasn't going to take the stand and be cross-examined by his former attorney,

Dan Rashbaum and company. Well, jury selection didn't even begin before the judge

just called it a day and ultimately told Donna she had to find new attorneys, which she did.

In the filing, Charlie said the conflict of interest with Attorney Rashbaum also infected his trial

in which he was found guilty and sentenced to life without parole.

The first district court of appeals rejected Charlie's request to send this back to the

lower courts in the hopes of getting a new trial.

And that's that.

But Charlie's not finished.

There is a new filing.

Charlie wants that new sentencing hearing. And let's read through this motion just to see what they're saying.

The defendant was convicted following a jury trial on first-degree murder, which is a capital offense, conspiracy to commit murder, and solicitation to commit murder.

The defendant submits there are errors in the

criminal punishment code sentencing score sheet that was utilized to sentence the

defendant for counts two and three which are the conspiracy to commit murder
