0:00.0	So jury deliberations in the nearly two-month-long Daniel Penny trial in New York City, they dragged into a new week this morning after that 12-person jury was unable to come to a unanimous
0:22.8	decision on the first and most serious charge of manslaughter, which as a result has been dismissed.
0:30.3	Now Daniel Penny was faced with account of criminally negligent homicide, which carries a
0:35.7	sentence of up to four years in prison and has a much lower
0:38.4	threshold of guilt than manslaughter. Now, if you recall, this is the case where on May 1st of last
0:43.6	year, a black drug-addled career violent criminal named Jordan Neely got on board a New York City
0:49.1	subway train and immediately started terrorizing the passengers. He was threatening their lives.
0:54.9	He was starting to get physical.
0:56.4	He was getting in altercations.
0:57.8	He was pushing people around.
0:59.1	He was obviously under the influence of drugs.
1:02.7	And the people on the train, according to their own statements, truly believed that they were about to die or be seriously injured.
1:11.2	So you have present, at present at that time, the imminent threat of great bodily harm or death.
1:19.0	So Daniel Penny, a 24-year-old white man and a Marine Corps veteran, sprung into action.
1:26.0	He got up and he started restraining this Neely guy. He took him onto the
1:30.7	ground and this submission hold that he reportedly learned in the Marines. And then, of course,
1:40.3	Neely died. So Penny protected himself.
1:45.1	He protected everyone else on that train until they got to the next stop.
1:50.0	And Jordan Neely could be dealt with by the police.
1:52.4	But unfortunately for Neely, who again was under the influence of drugs, had already died.
1:58.5	Apparently not immediately, though.
2:00.1	Apparently not while Daniel Penny had him in the headlock, but shortly thereafter.
