The Supreme Court puts a hold on to President Biden's changes to the border policy,

as more details trickle out about Congress's $1.7 trillion omnibus spending package.

Welcome, I'm Kyle Peterson with the Wall Street Journal.

We are joined today by my colleagues, editorial board member,

Manet Ugué Barua, and columnist Kim Strassel.

The Biden administration is preparing to end the pandemic title 42 policy of summary,

expulsions at the border, and yet this week Chief Justice John Roberts put a hold on that,

asking for a response from the Biden administration.

Manet, just to start out with, I guess, maybe remind us what the history of this title 42 policy is,

and how we got here to this court case to the Supreme Court.

So title 42 is a name for a policy that was first invoked by the Trump administration in March of 2020.

So basically, the CDC can decree that there is a public health emergency,

and the federal government is able to then turn away anyone who enters the country who is not authorized to do so,

even before they're able to declare asylum.

And so, theoretically, this was used to prevent the spread of COVID beginning in March of 2020,

but even from very beginning of the policy, it's been clear that the main advantage of it was that it could be used to turn away

a large share of migrants crossing the southwest border illegally without having to have them processed by the Department of Homeland Security

in their pursuit of an asylum claim.
