Summary

Jen Psaki breaks down the arguments that the Supreme Court will soon hear about whether the 14th Amendment disqualifies Donald Trump from the ballot. She’s joined by the former NAACP Legal Defense Fund president and lawyer, Sherrilyn Ifill, as well as Colorado Secretary of State Jena Griswold to talk about the merits of the case, Trump's legal strategy, and the history behind the 14th Amendment. Congressman Colin Allred of Texas joins Jen to discuss the latest reaction to the Senate's compromise border bill, as Republicans increasingly turn against it. Jen also breaks down the GOP's strange transition from a party of Russia hawks to a party of Putin apologists, discussing the implications for Ukraine with Former Deputy National Security Adviser under Obama, Ben Rhodes. Finally, Jen explores Donald Trump's propensity to attack the Federal Reserve when the condition of the economy doesn't serve his political interests.

Well, it's shaping up to be a really big week for the country because this week, the Supreme Court is going to hear oral arguments on whether the 14th Amendment disqualifies Donald Trump from the ballot.

0:20.5

And today, just a few hours ago, actually, we got a pretty good window into how Trump's

0:26.2

legal team plans to make their arguments.

0:29.1

And let me tell you, this brief, I read it today, includes a fair number of arguments from

0:34.2

an alternate universe.

0:36.0

For starters, Trump's lawyers claim the former president is not, in fact, an officer of the United States, which is who the 14th Amendment covers.

0:44.4

Now, this is not a new or surprising argument necessarily being made by the Trump team, but let's be real.

0:51.3

It kind of defies logic.

0:53.0

I mean, how could it be that the president of the United

0:55.9

States is not an officer of the United States, with an obligation, by the way, to abide by the

1:00.9

Constitution? Wasn't that kind of what the founders had in mind? But then there's the other, perhaps

1:06.7

even more startling piece, at least to me, a revisionist history that is included in this brief,

1:12.6

that Donald Trump did not engage in an insurrection. In fact, according to the argument here,

1:18.1

it was not an insurrection at all. The brief actually includes these claims. One, there was no

1:24.0

insurrection. Two, Trump did not incite anything, and President Trump did not engage in anything

1:29.3

that constitutes insurrection.

1:31.4

It even goes so far as to explain

1:33.1

why the events of that day were not an insurrection at all,

1:36.8

including that it lasted only about three hours.

1:39.9

What a weird argument that is.

1:41.5

And few, if any, carried firearms.

1:45.7

Okay, let's pause on that.
