Hello, thank you so much for joining me today for Give Him 15. The title of our post today is

Back at the Court. A despot is a king or other ruler with absolute unlimited power. Despatism, then,

is absolute power or control or tyranny with these definitions in mind

consider the following statement from Thomas Jefferson who said on September 28th

1820 in a letter to diplomat William Jarvis, quote,

You seem to consider the judges as the ultimate arbiters of all constitutional questions,

a very dangerous doctrine indeed, and one which would place us under the despotism of an oligarchy.

Our judges are as honest as other men, and not more so.

And their power is the more dangerous, as they're in office for life and are not responsible,

as the other functionaries are are to the elective control.

The Constitution has erected no such single tribunal, knowing that to whatever hands confided,

with corruptions of time and party, its members would become despots, end quote.

Jefferson once said, quote,

the great object of my fear is the federal judiciary.

In all right to Abigail Adams, September 11, 1804,

Prophet Jefferson warned of giving, warned again, of giving judges too much power.

And he said, nothing in the Constitution has given them a right to decide for the executive,

more than to the executive to decide for them.

The opinion, which gives the judges the right to decide what laws are constitutional and whatnot,

not only for themselves in their own sphere of action,

but for the legislature and executive, also in their spheres,

would make the judiciary a despotic branch.
