Another court date. I'm Lisa Lissera, Fox News. Three judges will decide if

former President Trump is immune from prosecution on election interference

charges as he continues to claim.

The three judges hearing this issue, Karen Henderson a George H. W. Bush appointee and judges

Michelle Childs and Florence Pan, both Biden appointees. All three including the Republican appointee, expressed skepticism

that Trump has total immunity.

Special Counsel Jack Smith's office argued this is a unique case that only President

Trump conspired with private

individuals to use the levers of power to stay in office after losing an

election and he did so not in his capacity as president but as a

candidate this issue is part of Trump's election

interference case. That trials on hold while the courts sort out this

immunity issue. Once these three judges rule, which could happen quickly,

either side could appeal to the

US Supreme Court. Fox is rich Edson the Pentagon says prostate cancer

surgery and a subsequent infection is was sent defense secretary Lloyd

Austin to the hospital last month, but White House National

Security Council spokesman John Kirby says there was a delay in President Biden getting the

information.
