Professor Hovenkamp teaches at Penn Law and at Wharton.

The New York Times once wrote that he is considered by many to be the dean of American antitrust law.

That is most accurate. I will not further belabor his accolades, but suffice it to say that they are many and that I am starstruck.

Professor Hovenkamp and I are going to be discussing the state of antitrust law, with, of course,

a focus on the tech industry.

What did the Biden administration get right or wrong?

What should the Trump administration do differently?

How can antitrust law make the tech sector better? Those will be our main themes. Then, I plan for us to wrap up with a lightning round on some of the landmark

It is such a great honor to have you. Let's start with a slightly unusual question for the tech policy podcast, at least, the way we cover things.

What are some of the things that you think the Biden administration got right with its antitrust

enforcement? What stands out?

Things that stand out to me are number one, more aggressiveness in behalf of labor.

The so-called labor share or the labor participation and the returns to production has been declining for actually for decades now.

And labor is falling behind.

Most of the antitrust laws apply equally to labor and consumers.

So I think it was well intended for them to ramp up on labor.

Another thing they did good was changing the concentration standards in the merger guidelines.

Merger guidelines were not sufficiently aggressive on that particular issue.
