I'm delighted to be here for another installment of the Washington Legal Foundation Tech Freedom Tech in the Courts series.

I'm also here as host of the Tech Policy Podcast. My warmest welcome to our

listeners there. Come in and register. That was the refrain. The crypto exchanges kept hearing

from SEC chairman Gary Gensler. But it was empty talk. The SEC has persistently refused to supply the

crypto industry with much needed guidance on how exchanges could possibly comply with the security's

laws. The agency has even had the audacity to claim that it can't issue rules because it's too

busy with other priorities. Never mind that it has had the time and

energy to sue the major crypto platforms in federal court alleging securities violations.

A federal judge recently called out this cynical campaign of regulation by enforcement.

It looks like you're going after the platforms, he said, in a way that will crush the industry

without getting into rulemaking. Government hostility toward crypto stretches beyond the SEC.

Several agencies appear to have engaged in a coordinated effort, sometimes called Operation

Choke Point 2.0 by its critics, to shut the crypto industry

out of the traditional financial system. But there are also bright spots. The CFTC has been

open to setting up reasonable crypto regulation, and the House recently passed a crypto bill that received a generally favorable response from the industry.

There are so many interesting regulatory issues surrounding the crypto industry.

Fortunately, I'm joined today by the perfect person to help us make sense of them.

Indeed, this man is at the center of the action.

I say these are interesting issues.
