On April 10, 2002, on Lyndon Boulevard and the flat-bush section of Brooklyn,

a man named Victor Vulcan was shot and killed in broad daylight just after school had left.

Fortunately, no one else was heard as people ran to their buildings recover,

including a young father named Gary Benloss, who had had prior rents with the police.

911 callers and eyewitnesses described the shooter with short hair, dark skin and a similar

build to the victim who was 5'10 and 168 pounds.

However, one alleged witness Anthony Holder, who did not give a description of the shooter,

said, among other falsehoods that the assailant's nickname was Chuck E.

Gary Benloss was known as Chuck E, but he was over 6'3 and 250 pounds, with a 7-inch high afro.

A photo of a much younger and slimmer Gary with short hair was put into a photo array,

a listening identification from Anthony Holder and one other witness.
