Count 11, violation of the declare war clause.

Well moving from the treaty clause that is embedded in Article II, Section 2,

Clause 2, to the Declaration of War Clause Article 1, Section 8, Clause 11, and that

one is in the minds of many Americans because that's one thing

they learn in high school they learned that the authority to declare war is

exclusively in the hands of the Congress.

Why did the framers put it in the hands of the Congress?

Well, it was one on the one hand, Ralph Ralph it's a unanimous decision.

Virtually no one.

Pierce Butler had a few comments at the convention which he renounced in South

Carolina ratification debates, but it was a hundred percent agreement we can never

trust the press to decide on war and peace because he's tempted to aggrandized

power by concocting conflicts that are totally unnecessary.

That's been the history of war from the beginning.

The executive branch that's always in the front lines trying to make excuses for war because they get all the power of the money

the appointments history books and all that kind of thing and so the framers at the

convention and in the discussions in the ratification debates like James Wilson

that we can never go to war unless both the House and Senate degree insisted that the
