A federal judge has dismissed the classified documents case against former president Donald Trump.

In a ruling this morning, Judge Eileen Cannon said the appointment of Special Counsel

Jack Smith violated the Constitution.

The dismissal follows criticism from Supreme Court Justice

Clarence Thomas about Smith's appointment.

What she's doing here is very much in line with what Justice Clarence Thomas on the Supreme Court said in a concurrence in the presidential immunity case.

He wrote about the Special Counsel's Office and Judge Cannon's finding here.

The reason that this case can't go before her is she says

this special counsel just doesn't have the power

in the way that she reads the Constitution.

Thus, it's done. CNN has reached out to Special Counsel Jack Smith for

comment. The Secret Service didn't sweep the building where the shooter in Saturday's

attempted assassination on

former President Trump was perched. Instead, a source familiar with the

investigation into the shooting says a local counter-sniper team was supposed to cover the building.

Homeland Security Secretary Alejandro Mayorkis said this morning that Saturday was a security failure.

When I say that something like this cannot happen, we are speaking of a failure.

We are going to analyze through an independent review how that occurred, why it occurred, and make recommendations and findings to make sure it doesn't happen again.

A video posted on social media shows that some of the attendees at the Butler Pennsylvania rally notice the gunman on the roof at least one minute before the shooting.
