There's lots of uses of the word pleading, but obviously today we're talking about something that comes up in many many cases.

I think we've talked about it kind of around it, but we've never really covered the mechanics

of plea agreements, whether you have a right to it, what's in a plea agreement, how to

effectuate a plea agreement, what the judge's role is, and whether it's a good thing or bad thing in our justice system.

So all big questions to cover, you guys have asked them before, so we are spending today's

episode to walk through some of these issues so that when you hear thrown out in one of the many cases you may follow

Oh so-and-so pled guilty or so-and-so is holding out for a plea agreement or so-and-so never was conveyed by their attorney that they had a plea offer.

What do those things mean?

Yeah, and one thing that we've tried to disabuse people of, which I don't know if we've

succeeded in this or not, is that please are very well thought out

things. They're not things, for instance, that you typically do at arraignment. When you show up and

the judge asks you for the first time how do you plead and you say not guilty.

And pretty much every case, whenever that happens, particularly if it's a case where we all know the guy did it.

I mean, take like a mass shooter or something

who gets arrested, and they plead not guilty.

They're always howls from social media.

I can't believe, how can he plead not guilty?

And it's because that's what you always do,

because while a plea in some sort of deep philosophical sense

...
