In the court's view, at least some of the acts and omissions alleged by South Africa to have

been committed by Israel in Gaza appear to be capable of falling within the

provisions of the Convention.

In light of the following, the Court concludes that prima facie it has jurisdiction pursuant to Article 9 of the Convention

to entertain the case.

Given this conclusion, the court considers that it cannot

accede to Israel's request that the case be removed from the general list.

That was the voice of one of the 17 justices who rendered a decision on in the case of genocide against Israel brought by South Africa just today, Friday, January 26, 2004, a monumental decision that makes it clear that the evidence brought by South Africa

constitutes genocide.

And while the court fell short of calling for a ceasefire which was the

express request of South Africa this decision is monumental in many ways.

This is an amazing ruling because it highlights everything that the South African team

and of course Palestinians have been saying the entire time which is that Israel

is plausibly carrying out genocide and so the fact that the court has indicated to Israel that

they have to take measures to prevent genocide, to

make sure that soldiers are doing the same, to prosecute those individuals who are

inciting, including high government officials,

and ensure that there is effective humanitarian aid

is precisely what was sought by Palestinians.
