And then put it this way, if it is the case that you should be punished for suggesting novel

case and legal theories or even challenging precedent, challenging the law on the books,

which John didn't do because there was very little law on the books. But if you were

able to punish people for that, then how could Brown versus Board of Education

have ever been litigated? Why didn't Southerners prosecute Thurgood Marshall or disbar him

for saying, I think all of the existing law here in these states approved by the Supreme Court

and plusee versus Ferguson is wrong. I mean, he was fighting uphill far more than I think John

Eastman was. And yet, you know, we did do that to the people during the civil rights movement.

We allowed them to make the broadest arguments possible to actually demand a change in the existing

law, settle precedent of decades and decades there. So I think what I think this is,

unfortunately, people using the law to try to punish their political enemies.
