Summary

Glenn was in the courtroom for the status hearing in Donald Trump's federal case in DC for attempting to overturn the 2020 presidential election. Donald Trump's lead attorney, John Lauro, started out the hearing loud and then got even louder. Indeed, Judge Chutkan twice told Lauro to "take the temperature down." Glenn reviews the ins and outs of the court hearing and discusses why Judge Chutkan may have settled on a March 2024 trial date for Trump's DC case. Then, Rolling Stone reported that, "Jack Smith's Team Grilled Witnesses About Rudy Giuliani's Drinking." Giuliani's intoxication may actually be relevant to one of Donald Trump's possible defense tactics to the criminal charges for his attempt to overturn the results of the 2020 presidential election: an "advice of counsel" defense. Glenn discusses why prosecutors often investigate matters of intoxication vis-a-vis with defendants, witnesses, and, yes, attorneys.

It's time for Justice Matters, with former Federal Prosecutor and MSNBC analyst, Glenn Kertner.

0:15.7

Glenn was in the courtroom when Judge Tanya Chutkin said a speedy trial date for Donald Trump

0:20.7

in his federal prosecution for trying to overturn the results of the 2020 election. Here's his take

0:26.0

on what he saw. So friends, I was in court for Donald Trump's status hearing in his criminal

0:33.6

prosecution in DC involving his attempt to overturn the presidential election, and I can tell you

0:41.0

there was a lot of heat in the courtroom, but it was all coming from the defense side of the

0:48.2

courtroom where all of Donald Trump's criminal defense attorneys had assembled.

0:55.2

So what I want to focus on is what I saw in that courtroom that I would characterize as

1:03.7

poor loyering, not trying to be unkind, but I have to call it the way I see it. Donald Trump's

1:11.6

lead defense attorney, John Lorrow. When he stood up and started addressing Judge Tanya Chutkin,

1:20.8

he started loud and he only got louder. In fact, twice during the hearing, Judge Chutkin had to

1:29.3

tell him to, quote, turn the temperature down. You know, Lorrow just engaged in bomb throwing.

1:39.7

He said, this is a show trial. This is a political prosecution. This is a grave injustice.

1:48.7

You know, he may have believed he was throwing red meat to Donald Trump's base,

1:55.8

but he was not persuading Judge Chutkin, right? He was not making arguments based on the facts,

2:04.4

based on the law, based on some reasonable estimate of how much time he would need to prepare for

2:12.2

trial. He was just throwing bombs and being loud. You know, interestingly, Judge Chutkin started the

2:20.4

hearing by saying the prosecutors, Jack Smith and his team are asking for a January second 2024

2:29.7

trial date. The defense is asking for an April 2026 trial date. She said point blank,

2:40.4

neither of those two trial dates is appropriate. So I thought, oh, maybe she's going to do the

2:48.0

salamonic thing, kind of split the difference, if not the baby, and maybe come down somewhere

2:55.5

in the middle. So what she did was she asked John Lorrow, listen, propose a reasonable trial date,
