University of Texas law professor Stephen Vladeck has written a new book that outlines how since 2017, the Court has dramatically expanded its use of the out-of-the-public-eye “shadow docket,” to regularly make rulings that affect millions of Americans without public hearings and without explanation. Conservatives on the Court have used the shadow docket to green-light restrictive voting laws and bans on abortion, and to curtail immigration and COVID vaccine mandates.
