For the record, the handcuffs have been removed from the defendant so that he can fully participate in today's hearing.

So the purpose of today really is to go through the motions and eliminate to see where I can give you some rulings and some expected rulings.

I always say expected rulings

because I like to think of a trial

as a living, breathing thing that evolves,

not something that is pre-planned.

So these are my best guesses.

Sometimes I'm making actually affirmative rulings

because I know enough that I don't think anything will change

but if it does change I'll let you know so I'll just start I'm going to go

through those motions that we went through a couple of weeks ago in the same order

as they're listed instead of I'll start first with the pretrial motions and what we have left over there are the following.
