Summary

Watch the full coverage of the live stream on The Emily D. Baker YouTube channel: https://youtube.com/live/X7H24DzEPnI Due to numerous public records requests in the Bryan Kohberger Case, law enforcement agencies in Idaho released over 200 crime scene photos online, some of which depict the victims, albeit blurred. Though it was blurred it still leaves room for the imagination and recommended that it be blacked out redactions. This widespread release occurred because the case did not go to trial, meaning the photos didn't undergo the official sealing process typically seen in court proceedings like the Alex Murdaugh case. The lack of judicial oversight in the release process of the Bryan Kohberger Case led to a lawsuit against the city of Moscow. Madison Mogen's mother, Karen Laramie, requested a temporary restraining order (TRO) after redacted crime scene photos were released. On August 15th, Idaho Second District Judge Marshall issued a TRO, blocking the city from releasing any further images, audio, or video depicting the inside of Madison Mogen's bedroom until a preliminary injunction hearing on August 21st. While the TRO specifically applies to Mogen's bedroom, the city has stated it will not release photos or videos from any victim's bedroom until the court fully reviews the matter. The attorney representing the families, Leander James, emphasized that the families want peace and not conflict, and urged the public to avoid viewing the photos. Welcome back. It's time for a case brief, keeping you in the loop with the cases you care about most,

0:03.9

just more briefly. If you want the full coverage, it's linked in the description below. But for now,

0:08.7

let's get into it. A lot of you had been asking about what is going on with the lawsuit over pictures

0:16.0

in the Coburger case. One of the problems that we are having in Idaho is that there have been

0:22.0

so many public record requests and different law enforcement agencies said, look, we're not

0:28.5

going to be able to accommodate all the public record requests. We're just going to put them up on a

0:32.5

website and you can just download them all. And so with that, there was a release of over 200 crime scene photos.

0:42.9

Some of you may have seen them online. That is not something I would ever share because here's how

0:47.5

that would go if this case had gone to trial. If this case had gone to trial, it is most likely that

0:53.7

the crime scene photos,

0:55.2

autopsy photos, and other type of photos, except for just a very few, would have been sealed

1:01.9

like we saw in the Murdoch case.

1:04.2

But in a trial process, the evidence would have gone through the official process of being

1:10.4

marked as evidence

1:11.1

and introduced as evidence and then sealed outside of the jury view.

1:15.5

So no one else would have access to it.

1:17.3

Because this did not go to trial, there are a ton of public records requests.

1:22.3

And it seems that the agencies aren't necessarily weeding out those requests, and they're like, we will just

1:28.9

make it accessible to everyone. But that included crime scene photos. And yes, some of the crime

1:34.4

scene photos are blurred, but there are still crime scene photos that have the victims in them,

1:40.8

though blurred. And I have not gone through and looked at all 200 photos.

1:44.4

Why? Because I've seen the police reports and I can tell you exactly what that's going to be like.
