Baker YouTube channel: https://youtube.com/live/V_gRWoUtPKY A hearing was held on August 5th, which was intended to continue the evidentiary portion of the motion to dismiss for the Myles King Murder Case, but this did not happen. Instead, the court requested the defense and prosecution to collaboratively create a comprehensive list of all evidence, when it was turned over, and which items are considered prejudicial by the defense. This is complicated by the fact that the prosecution did not consistently bate stamp documents. Another significant issue is the ongoing delay in receiving discovery related to Former Trooper Michael Proctor's text messages, which are relevant to five cases, including the Myles King case. The court is waiting for federal authorities to release this discovery. The defense is frustrated by the continuous "dripping faucet" of new discovery, making it difficult to prepare their case. The bar for dismissing a case due to discovery failures in Massachusetts is high, and typically, the remedy is to grant more time for trial. The Karen Read case has brought attention to this widespread issue of lingering discovery in Massachusetts cases. The next hearing for the Myles King case is scheduled for August 12th at 2pmET, where the judge will continue to try and clarify the specific evidence at issue for the motion to dismiss. Neither Adam Lally nor Proctor testified on August 5th, and they are not expected to testify on August 12th either. Welcome back. It's time for a case brief, keeping you in the loop with the cases you care about most,

just more briefly. If you want the full coverage, it's linked in the description below. But for now,

let's get into it. Let's talk a little bit about what we're going to court in. It is a homicide prosecution.

0:16.6

The defense attorney that we will see in court is the defense attorney for Miles King.

0:21.1

There's also a co-defendant in this case.

0:23.2

The allegations here are all surrounding a pending motion to dismiss centered around failing to disclose discovery.

0:32.7

And the Commonwealth also agreed to the continuance.

0:35.5

Why?

0:36.8

Because there's a new DA on this case, not Adam Lally, who had the case originally, and the new DA on the case seems to acknowledge that all of this is just ridiculous.

0:49.2

But for years, Adam Lally did not turn over discovery. And when we watched the last hearing, which we will link down below, when we watched the last

hearing, he was like, hmm, I mean, they'll get it eventually.

1:02.0

Discovery is an ongoing obligation.

1:04.8

First of all, that's not what that means.

1:07.5

Discovery being an ongoing obligation means that if something new comes in, you are

1:14.0

still obligated to turn it over. Like just because the discovery deadline is passed, if you receive

1:19.5

something new, you still give it to the other side. It's not like discovery ends. New things

1:24.2

mean new disclosures. It doesn't mean turn it over whenever you want to.

1:30.3

That's not what it means.

1:33.3

And it seems that everybody's been rolling with,

1:36.3

we'll turn it over appropriately.

1:40.3

No, you won't.

1:41.3

Part of the fault I find in this is not just the district attorney's office for not doing their job. It is ultimately the district attorney's responsibility. And if law enforcement is not giving things to the district attorney, it is the district attorney's job to escalate it. If it needs to be escalated to the court, you go to the court and then you say, I need a court
