This is John Bachelor. What follows is an excerpt from a conversation with Professor Richard Epstein, Senior

Fellow at the Hoover Institution, teaches law at the University of Chicago and NYU, about the

Supreme Court decision to hear a case based upon the decision 4-3

by the Colorado Supreme Court that forbids Donald Trump's name to be included in the primary ballot for the Republican Party in Colorado.

The question is, based upon 14th Amendment, Section 3, especially the word insurrection,

insurrectionist.

The professor comments on that.

He also comments on Michael Luteg, a conservative former judge on the Fourth Circuit, US Court of Appeals, who along with

Lawrence Tribe is published in the Atlantic an article in which they're very confidently certain that Donald Trump is not eligible

to be president of the United States or to run for the presidency because of the

word insurrection. Richard speaks of this matter in terms

of the concept of self-executing. Does being an insurrection is self-execute? you don't need to be condemned by anyone else.

You are ineligible to be an officer in the United States to run for office, self-executing.

Richard gives an example of age being self-executing when it comes

to eligibility for the presidency. Here's Richard Epstein, commenting on not just Michael Lutted, but the whole argument that Donald Trump

is not eligible and that he cannot go to the voters because he was part of an insurrection.
