This is John Batchel, speaking with colleague John U, Professor John U of Berkeley, also at the Civitas Institute, University of Texas,

about his expectation of the Supreme Court oral hearings for the temporary restraining order nationwide question and the birthright citizenship question.

John, you expect the court to seize on the procedural matter and put it back down to the lower

courts to decide the birthright citizenship and wait for it to come back. He'll explain here.

In other words, kick the can. Maybe a year, maybe more. John New, temporary restraining order nationwide question mark,

birthright citizenship, question mark. Much more of this tonight. I think I go with the way

your question might have been leading, which is I think the six

right of center justices are going to focus on the nationwide injunction question.

And once they say no more nationwide injunctions, then they'll say, and now we're going to

send the case back down to those district judges,

and they have to reconsider it. And as you say, kick the can down the road on birthright

citizenship, because it will return to the court in about a year, because those same district

judges will probably block the executive order again, and then this will get appealed up the normal process, and that takes

about a year to get to the Supreme Court. The reason why I think they will do that is I think

Chief Justice Roberts is worried about the political pressure that's being placed on the court. You

have people calling for the impeachment of judges.
