0:39.8	female genital mutilation, where a judge in Michigan overturned a federal law or declared
0:49.3	a federal law against female genital mutilation unconstitutional.
0:55.7	And he did this on federalism grounds.
1:00.0	In other words, he didn't, he wasn't saying that he approved of it, that he approved of the process,
1:08.4	but he was saying that the argument went, that Congress didn't have the right to outlaw a practice like this, right?
1:19.6	So his argument was a Federalist argument and that would be easier to take if people applied federalism
1:28.7	principles across the board and not just when they cut in the direction of political correctness.
1:35.6	So leaving aside for a moment the question of who ought to pass laws against this.
1:44.2	And I am sympathetic with the argument
1:46.4	that that should be a state-level thing,
1:50.9	that should be a state-level enterprise, nevertheless the fact that this practice is starting
1:57.8	to take root in America, people are starting to see it as their, you know, this is one of their customs that they have to be allowed to practice,
2:11.0	raises a host of questions.
2:17.0	And of course, the central question it raises
2:22.1	is the question of secularism.
