There's just no way to argue that there is some type of like emergency in which this act needs to be invoked.

The only question is whether a right wing judiciary will say you can do it whenever you want is essentially.

Like this president's prerogative. And that's that is something that would have been completely impossible for George W. Bush to have done in the wake of 9-11.
