Well, howdy there, Internet people, it's Bell again. So today, we're going to talk about Biden's

parting gift to Trump and the environment. Well-sourced, but as of yet, not officially confirmed.

Reports are saying that Biden plans on using the Outer Continental Shelf Lands Act to withdraw a massive amount of

federal waters from future oil and gas leasing and development. Some reports put it at 625 million acres.

Some have described it as including all of the Atlantic coast and eastern Gulf of Mexico, most of the

Pacific coast, sections of Alaska's northern Bering Sea. It's basically almost the entire coast.

This is a penstroke thing for Biden, and normally what's done with a penstroke can be undone with a pinstroke. But the

Outer Continental Shelf Lands Act has this weird thing about it. It grants a sitting president massively

broad powers to withdraw waters from leasing. But it doesn't explicitly grant a president the ability to return waters that have been withdrawn.

The authority, it's just not in the law. The law has been challenged in federal court before

by Trump in 2019 when he tried to get rid of Obama-era withdrawals around Alaska.

The law stood.

So, it would seem like if Trump wanted to undo this,

he'd need to get Congress to change the 1953 law.

That seems like something that wouldn't get through the Senate.

So, what's the rhetoric?

Undoubtedly, Trump will say it's unconstitutional or illegal, or it's too late for Biden

to do it, or whatever.

It's worth noting that in 2020, before leaving office, Trump put a ban on leasing in some of the expected areas until 2032.

Currently, Trump is on a kick complaining about offshore production in the U.K.

Saying, quote, the U.K. is making a very big mistake.
