Summary
After an intro in which Jesse impresses Katie deeply with a brilliant, cutting-edge character he has clearly put a lot of time into developing, the hosts discuss a hellish few days in Kenosha, Wisconsin: first, the police shooting of Jacob Blake, and then Kyle Rittenhouse's killing of two protesters. Doesn't there have to be a better way for police to resolve altercations like the one that ensued with Blake? And will the unrest in Kenosha increase the chances Donald Trump is elected (Katie's view), or is there not yet much evidence to suggest it will (Jesse's)? Plus: You will never guess whether or not the hosts think mainstream outlets are doing a good job covering all this.

PolitiFact: Did Kyle Rittenhouse break the law by carrying an assault-style rifle in Kenosha? - https://www.politifact.com/factchecks/2020/aug/28/facebook-posts/did-kyle-rittenhouse-break-law-carrying-assault-st/ (note this from the end, indicating ambiguity: "Whether Rittenhouse violated Wisconsin law by possessing a firearm underage is the subject of ongoing litigation.")
On the question of whether the misdemeanor doesn't apply here, the action seems to be in this bit from the Wisconsin state code: "This section applies only to a person under 18 years of age who possesses or is armed with a rifle or a shotgun if the person is in violation of s. 941.28 or is not in compliance with ss. 29.304 and 29.593." The argument is that those other conditions don't apply, Rittenhouse wasn't in violation, but we'll get a clear answer on this when he is or isn't convicted.
Simple Justice: Prickett: Update on Kenosha - https://blog.simplejustice.us/2020/08/28/prickett-update-on-kenosha/ (legal analysis of both the Blake and Rittenhouse cases)

| 0:00.0 | Hey, it's me Jesse. In this episode, Katie and I discussed the case of Jacob Blake, the men who was paralyzed after getting shot in the back by police in |
| 0:08.3 | Kenosha, Wisconsin, setting off unrest and further violence there. During the episode, we mentioned the competing narratives about why Blake was where he was at the time of the shooting, which were coming from different camps, you know, from his side versus the police. |
| 0:23.0 | Just so everyone is on the same page in terms of the basic facts, it appears the version of events I mentioned in which Blake showed up to mediate a dispute is false. |
| 0:32.0 | The New York Times reports that Blake had an arrest warrant for sexual assault, criminal trespass, and disorderly conduct, and that he was shot at the apartment of his alleged victim who had called 911 to report his presence there. |
| 0:44.0 | The New York Post adds that she had a restraining order against him. Both outlets relay the law enforcement claim that the officers on the scene were aware of all this and the post appears to have gotten hold of dispatch records which confirmed this claim. |
| 0:57.0 | In addition, contrary to what we say in the show, Blake did have a knife in his hand at one point. This wasn't just about the possibility of a weapon in his car. |
| 1:05.0 | To be clear, Katie and I stand by what you'll hear us say in this episode about the need to find better ways to de-escalate these sorts of situations. |
| 1:12.0 | We both believe what happened was senseless and unnecessary regardless of the accusations against Blake. But we did want to be clear about the actual facts, at least as they're understood as of today, August 29, 2020. |
| 1:23.0 | Including the show notes, links to the time spes, the post piece, and a legal analysis about some of the challenges to prosecuting the police officer who shot Blake that may arise. |
| 1:33.0 | In addition to all this, I note in the show that it was illegal for Kyle Riddinhouse, the 17 year old who killed two protesters in the wake of Blake shooting to be in possession of the AR-15 he was carrying around in Wisconsin. |
| 1:45.0 | Riddinhouse was charged with this misdemeanor and multiple outlets have argued that he did break the law. But for what it's worth, this may be based on a misunderstanding of the law, in which case it would be difficult to get a conviction on this particular charge. |
| 1:58.0 | For what it's worth, this was the least serious of the multiple charges Riddinhouse is facing. But since I relayed this claim that it was illegal, I just wanted to note that there's some controversy here. |
| 2:07.0 | Once again, I'll include everything you need in the show notes to sort of dig further into that question. Anyway, thank you for listening and I hope you enjoy the show. |
| 2:16.0 | Jesse, how's it going? |
| 2:17.0 | Good! I've been doing a little bit of brainstorming. |
| 2:20.0 | What's going on in that Brandi-O-Rus? |
| 2:21.0 | I mean, so we've been getting a lot of feedback. People want the show to have more characters on it. You know, just these hilarious situations and characters we've come up with. We already have Katie Herzow, right? |
| 2:32.0 | Who is the... |
| 2:33.0 | Yeah, my intern. |
| 2:34.0 | You're a transphobic intern who people confuse you with all the time. That's one. |
| 2:38.0 | Yeah. |
| 2:39.0 | What do you think about a woke airline pilot? |
