complications as we approach the election year of the allegations against former President Donald

Trump federal court federal court in DC that's special counsel Smith prosecuting and federal court in Florida.

And that is Special Counsel Smith proceeding prosecuting as well.

Two different judges and we're going to concentrate on

Chutkin, Judge Chutkin who's just passed down a ruling on immunity. And

Andy, what I understand to be the complications of immunity is did or did not the former

president make decisions and conduct himself and his affairs in a fashion that was or was not part of his

official duties. Is that the question that is now going to be decided?

Yeah, well that is one of the questions. What Judge Chutkin has found John is that regardless of whether his actions were within the ambit of his official duties or not, because it's a criminal prosecution he does not have immunity.

And again that's the question that the Supreme Court has never resolved but to be fair to Judge Chukin, the cases that she relied on

that are in the area of this question about criminal prosecution.

I think she did correctly read them to indicate that if that issue had come up

before the Supreme Court, they would have decided against immunity. That is?

And isn't it possible to make a distinction between a personal crime and a political crime?

Political crime being subject to much interpretation, subjective interpretation.
